“MASSIVE In-Game Advertising Service Privacy Statement

Massive Incorporated (“Massive”), a wholly-owned subsidiary of Microsoft Corporation, is working hard to help protect your privacy, while delivering software and services that bring you the performance, power, and convenience you desire. This privacy statement explains the data collection and use practices of Massive’s In-Game Advertising Service (the "Service”). It focuses on features of the Service that communicate with the Internet, and it does not apply to other online or offline Web sites, products, or services.
The Service delivers advertisements over the Internet to people playing video games (“gamers”) on-line and to collect statistics about those advertisements. The Service is offered only to game publishers and game developers and not directly to gamers, and only operates in a game if the game publisher or developer has incorporated the Service in the game.
Games may have their own data collection and use practices outside of the use of the Service. For example, some games may require you to register in order to play. Any information collected by your game’s publisher will be subject to the publisher’s privacy practices.
Collection of Your Information
If a video game publisher or developer has incorporated the Service into a game, some information will be collected and transmitted to Massive on a regular basis as you play the game. Examples of information collected and sent to Massive include:
· Game Information. The title of the video game as well as the start and stop time of the game session.
· Advertising Delivered. Statistical information, such as advertisements’ time and size on the screen as well as a count of the number of times a given advertisement has been displayed within a game.
· Internet Protocol (“IP”) Address. The IP address of the connecting computer or game console, which is sent as part of all Internet communications. Massive does not store the last octet (field) of the IP address to help avoid storing information that could be used to personally identify you.
· Computer or Game Console Information. A globally unique identifier (GUID) is generated to allow us to count unique computers and game consoles connected to the Service. The GUID is a randomly generated number; it does not contain any personal information and is not used to identify you.
Use of Your Information
The information sent to Massive is used to operate, maintain and improve the Service. It is also used to generate aggregate statistics that help us analyze trends and improve our products and services, as well as those of our affiliates.
In order to offer you a more consistent and personalized experience, information collected by Massive may be combined with information obtained through the other services of Massive and our affiliates. We may also supplement the information collected with information from other companies. For example, in an effort to customize certain services, we may use services from other companies to determine your general geographic location based on the partial IP address of your computer or game console. This helps us deliver advertisements that are more relevant to you.
None of the information collected will be used to identify or contact you.
Sharing of Your Information
Massive does not sell, lease or rent the data collected in connection with the Service, but it may provide analysis and aggregate data to game developers, game publishers, advertisers and advertising agencies. From time to time, we may publish or report aggregate statistics related to the Service. When such reports are published, they do not include or reveal any information identifying specific game players.
Massive and our affiliates occasionally hire other companies to provide limited services on our behalf, such as Web site hosting and service auditing. We will only provide those companies the information they need to deliver the services for which they are hired. They are required to maintain the confidentiality of the information and are prohibited from using the information for any other purpose.
Massive may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us or the Service; (b) protect and defend our rights or property; or (c) act in urgent circumstances to protect the personal safety of users of our products or services or members of the public. We will not use the data collected through the Service to investigate potential violations of agreements you may have with us or our affiliates.
Information collected by the Service may be stored and processed in the United States or any other country in which Massive or its affiliates, service providers or agents maintain facilities. Massive abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.
Security of Your Information
Massive is committed to protecting the security of your information. We use a variety of security technologies and procedures to help protect your information from unauthorized access, use, or disclosure. For example, we store the information we collect on computer servers with limited access that are located in controlled facilities.
Use of Cookies
The Service does not use cookies and neither installs nor stores any persistent tracking mechanisms on game players’ computer or game console.
Changes to this Privacy Statement
We may occasionally update this privacy statement. When we do, we will also revise the "last updated" date at the top of the privacy statement. For material changes to this privacy statement, we will notify you by placing a prominent notice on the home page of the Service’s Web site. We encourage you to periodically review this privacy statement to stay informed about how we are helping to protect the information we collect. Your continued use of games that incorporate the Service constitutes your agreement to this privacy statement and any updates.
